Procedure for requests for the review of decisions

Rule 2.2.1: "The FSCS must administer the Compensation Scheme in accordance with the rules in this sourcebook and any other rules prescribed by law to ensure that the Compensation Scheme is administered in a manner that is procedurally fair and in accordance with the European Convention on Human Rights".

Procedure

This procedure sets out how the Scheme deals with objections to, or the request for a review of, a decision made by the Scheme in the course of its work; for example, an offer of compensation, a rejection of a claim, or a declaration of a default.

This procedure does not apply where you provide new or further material evidence relating to the decision, in which case we will reconsider the original decision as if it were a fresh application.

On receipt (or renewal) of an objection or request which is subject to this procedure, we will review the case. The reviewer may consult colleagues within the Scheme as appropriate. If we think the issue should be considered at a higher level of authority than provided for by the flowchart or the current reviewer made the original decision now under review, the case will be referred directly to the next level of review.

If the matter is referred to the Chief Executive under this procedure, the Chief Executive will consider the matter, the previous reviews, and if appropriate the decision.

This procedure may be augmented to deal with any particular issues or concerns, as appropriate, for example to arrange a meeting or an oral hearing.

This procedure ensures that the Scheme fulfils its statutory duty and that its decisions are correct in the light of all relevant and available material. If at any stage the review results in a fresh decision, to which you object, any further review will first be carried out at the level at which the fresh decision was issued.

If our decision remains the same, after the Chief Executive's review, the Chief Executive will inform you that the matter will be regarded as closed and you may take it further only through litigation (legal action).
