ARM and Rockingham

FSCS has received a small number of queries from Rockingham investors asking FSCS about the position of the Commission de Surveillance du Secteur Financier (CSSF) in its handling, as regulator, of the situation with ARM. We understand that CSSF in Luxembourg has also received some similar queries.

In determining investors’ claims against Rockingham, it is not for FSCS to judge the role or decisions of the regulator in Luxembourg, and FSCS has not done so.  Our role is to consider the liability of the failed UK authorised firm, in accordance with our rules.  In this case, we have determined that Rockingham does not owe a legal liability for losses that claimants may have suffered in relation to ARM investments.
